Okla. Admin. Code § 340:75-19-22 OKLAHOMA ADMINISTRATIVE CODE TITLE 340. DEPARTMENT OF HUMAN SERVICES CHAPTER 75. CHILD WELFARE SUBCHAPTER 19. WORKING WITH INDIAN CHILDREN
340:75-19-22. Tribal residential placements for DHS custody children The Federal and State Indian Child Welfare Acts (ICWA) address the placement of Indian children in "an institution for children approved by an Indian tribe or operated by an Indian organization which has a program suitable to meet the Indian child's needs." This is listed in the Federal ICWA as the last placement preference. Before an Indian child in DHS custody is placed into such a placement, all other preferable placement options are explored and documented. If no other preferable placement is available and the residential placement has a program which is suitable to the child's needs, placement can be considered if the facility has entered into a placement agreement with the Department.
