340:75-19-2. Legal authority The Federal Indian Child Welfare Act of 1978 (FICWA or Federal Act) and Oklahoma Indian Child Welfare Act of 1982 (OICWA or State Act) [10 O.S. § 40 through 40.9] provide the legal basis for services to Indian children. The stated purpose of FICWA is to protect the best interests of Indian children and to promote the stability and security of Indian tribes and families. The FICWA establishes minimum federal standards for the removal of Indian children from their families and ensures the placement of Indian children in foster or adoptive homes which reflect the unique values of Indian culture. The OICWA requires the State of Oklahoma to fully implement and cooperate with the provisions of the Federal Act, and sets some standards above and beyond the requirements of the Federal Act.
